Supreme Court: “Death Too Harsh for Child Rapists”

  • The Supreme Court ruled early on Wednesday that raping a child is not punishable by death. Violently and repeatedly raping an innocent child, one that has to forever live with the anguish, does not deserve death? Do those that voted against the death penalty for such sick and twisted acts not have children? In my mind the only thing as wrong as murder is the molestation of an innocent little child.

    Death is a merciful punishment for these people. If you ask me I think there should be a worse punishment than death for these types of criminals. I won’t get into it–you can use your imagination–but death is far from too harsh. If a child is repeatedly raped, forced to commit such horrific acts, their entire life’s are scarred with the punishment that they have received. When you murder someone their punishment has ended, when you rape a child they are left to live with the anguish and pain that they have been struck with throughout their lives.

    However devastating the crime to children, Justice Anthony Kennedy wrote in his majority opinion, “the death penalty is not a proportional punishment for the rape of a child.” His four liberal colleagues joined him, while the four more conservative justices dissented.

    Bobby Jindal of Louisiana’s response was right on. “The opinion reads more like an out-of-control legislative debate than a constitutional analysis,” said Louisiana Gov. Bobby Jindal, a Republican. “One thing is clear: The five members of the court who issued the opinion do not share the same ’standards of decency’ as the people of Louisiana.”

    At this moment there are only two men that have been sentenced to death, in Louisiana, for the rape of a child. Rape on it’s own is a disgusting, unforgivable act. You take it one step further when the victim is a young child. So who is the man being saved by the Supreme Court? Patrick Kennedy. What was his crime? Brutally raping his 8 year old step daughter.

    L. H. [the 8-year-old rape victim] was transported to the Children’s Hospital. An expert in pediatric forensic medicine testified that L. H.’s injuries were the most severe he had seen from a sexual assault in his four years of practice. A laceration to the left wall of the vagina had separated her cervix from the back of her vagina, causing her rectum to protrude into the vaginal structure. Her entire perineum was torn from the posterior fourchette to the anus. The injuries required emergency surgery.

    Instead of being put to a humane and peaceful death, Kennedy gets to sit in a cell the rest of his life. The only thing we can hope for is for a fellow prisoner to do the decent thing that the court decided was “too much for crime committed.” You know a crime is horrific when even prisoners look down on it. Rapists can rejoice. Your heinous acts of brutally destroying a child’s life is not punishable by death. You can go about your way knowing that when you are caught you will receive free food and shelter for the rest of your life at the expense of the state. That child? They will live on, in fear, because the Supreme Court lacks the moral capacity to do the right thing.

    I’m a proud conservative, and as a conservative who tries to follow Jesus’ teachings as much as possible, I can’t see a context in which He would condone the death penalty for this case. I understand you may not be a Christian, but this goes way beyond an eye for an eye.

    I am a Christian, I also don’t follow “an eye for an eye” because that is old law. We are talking about justice, death is justice for such an act. What do you suggest they do? A lawful trial that will end up with the man in a cozy jail cell? A free ride while his victim contemplates suicide and cries herself to sleep, her life forever in ruins? Being stuck in a prison is not a justified punishment for this crime.

    Also chiming in from a Christian perspective here-

    I could be completely wrong; but my reading of the Bible and New Testament in particular seems to indicate that Jesus wasn’t interested in government and its laws- render unto Caeser and so forth.

    Christianity seems to support, instead, the idea that we need to be good citizens of whatever country we are in, and that includes countries that choose to have the death penalty to prevent crime.

    In this case, the citizens of Lousiana and their legislature followed their laws perfectly, and enacted legislation. The supreme court, outside of its proper consituational bounds, overruled the will of the people.

    Regardless of what we may think in terms of Jesus’ opinion (note that he did NOT save the mortal lives of the thieves while he was on the cross- and they were convicted of the crime of basically petty theft), American law was once again spat on by our own supreme court. That is an affront to us all because this clearly did not infringe upon the consitutional rights of anyone.

    I too am a christian, and I too was abused by my stepfather. None of you holy rollers have any right to say anything until you’ve been through it. Ten years of fear. Ten years of torture. Ten years of rape, molestation, and physical abuse. Ten years of not sleeping at night in fear he might come into my room this time. I am a thirty year old woman with no children of my own to love and still wake up scared sometimes. For those of you out there who are mad about rapists not getting the death penalty don’t be. My stepfather was raped reatedly in prison, and beaten. I’m glad they go to prison instead of having an ending as easy as the death penalty. Those prisoners don’t take that kinda crime lightly. My soul was crushed by this monster. I can thank him for not being able to have children or have a normal life.

    First let say that I’m sorry you went through that. I can’t say that I understand how it feels to be abused and treated so inhumanly but that won’t stop me from voicing my opinion against the horrible act.

    My sister was molested at a very young age so the tragedy has hit home for me and my family. The prison system will weed these type of criminals out but there’s no guarantee that they won’t be placed in solitary confinement so they are not hurt.

    I understand your resentment but want to insure you that I am on your side. I’m not the enemy. What happened to you is inexcusable. I am speaking out against abuse, especially of women and children. I want to see these creeps punished in the worse way legally possible.
